{"id":209192,"date":"2026-09-24T08:43:57","date_gmt":"2026-09-24T06:43:57","guid":{"rendered":"https:\/\/scm.org\/?p=209192"},"modified":"2026-09-24T08:43:58","modified_gmt":"2026-09-24T06:43:58","slug":"38-global-civil-society-organisations-file-joint-brief-in-us-lawsuit-challenging-legality-of-trumps-sanctions-against-the-international-criminal-court","status":"publish","type":"post","link":"https:\/\/scm.org\/en\/38-global-civil-society-organisations-file-joint-brief-in-us-lawsuit-challenging-legality-of-trumps-sanctions-against-the-international-criminal-court\/","title":{"rendered":"38 global civil society organisations file joint brief in US lawsuit challenging legality of Trump\u2019s sanctions against the International Criminal Court"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Trump administration\u2019s <a href=\"https:\/\/makingjusticework.org\/en\/content\/coercion-of-justice-and-sovereignty-the-united-states-campaign-to-dismantle-the-international-criminal-court-urgent-action-by-states-parties-threats-to-justice-team-paper\/\">escalating campaign<\/a> against the International Criminal Court (ICC) is reaching far beyond the judges, prosecutors, and human rights groups it has sanctioned, chilling civil society engagement with the Court and undermining victims\u2019 access to justice, Amnesty International, the International Federation for Human Rights (FIDH), and 36 other Civil Society Organisations (CSOs) said today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>23 September 2026.<\/strong> Yesterday, 38 civil society groups jointly filed an <em><a href=\"https:\/\/www.fidh.org\/IMG\/pdf\/civil_action_no._26-cv-06830_jmf_amici_submission_filed_20260922.pdf\">amicus curiae<\/a><\/em> (&#8220;friend of the court&#8221;) brief with the United States (US) District Court for the Southern District of New York <a href=\"https:\/\/ccrjustice.org\/home\/what-we-do\/our-cases\/american-friends-service-committee-et-al-v-trump-et-al\">in support of a lawsuit<\/a> filed by the American Friends Service Committee, the Center for Constitutional Rights, Human Rights Watch, and the Open Society Institute, which challenges the legality of sanctions imposed under <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-sanctions-on-the-international-criminal-court\/\">Executive Order (EO) 14203<\/a>. The sanctions have targeted ICC prosecutors and judges, a United Nations (UN) human rights expert, and three Palestinian human rights groups.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;<em>Behind every civil society organisation being silenced or pushed away from the ICC are victims and survivors waiting for justice. These sanctions are disrupting the networks of people and organisations that stand with victims who bring their stories and evidence before the Court, and spreading fear far beyond those directly targeted<\/em>,&#8221; said <strong>Alexis Deswaef, President of FIDH<\/strong>. &#8220;<em>For victims who have already been failed by justice at home, closing these pathways can mean losing one of their last chances for accountability<\/em>.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;<em>As the Trump administration steps up its attacks on the ICC and the civil society organisations essential to its work, it is crucial to demonstrate to the US Federal Court how sanctions are harming global civil society, victims and survivors of crimes under international law, and the very idea of international justice,<\/em>&#8221; said <strong>Agn\u00e8s Callamard, Amnesty International\u2019s Secretary General<\/strong>. &#8220;<em>We will not sit back and let President Trump destroy the Rome Statute. The sheer number of civil society organisations submitting this brief demonstrates the resilience and determination of civil society to oppose the US sanctions and protect the ICC.<\/em>&#8220;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CSOs\u2019 brief makes two fundamental arguments.<br>First, the sanctions are fracturing civil society networks that are essential to the functioning of the ICC. CSOs and human rights defenders, including lawyers, victim representatives, and survivor-advocates, carry out a wide range of activities which the ICC depends on: connecting victims and witnesses to the Court; documenting atrocity crimes; supporting victim participation and reparations; contributing critical legal, contextual, and cultural expertise; and advancing state cooperation and domestic investigations and prosecutions, particularly in situation countries where the Court has limited access.<br>Second, by imposing and threatening draconian financial and legal penalties on CSOs and individual actors, EO 14203 violates their rights to freedom of expression and association and has severely damaged the collaboration and infrastructure upon which the international system of justice depends. EO 14203 has already caused the Designated Entities to lose funding, staff, banking access, and partnerships; deterred CSOs from engaging with the ICC; and fractured relationships between and among many CSOs.
